Once we receive complete and accurate information (site address, proposed dimensions, location, and builder details if applicable), our drafting timeframes are:
BA02 (Uncertified) Patio Approval: Approximately 4 business days
BA01 (Certified) Patio Approval: Approximately 7 business days
These timeframes cover preparation of council-ready plans and documentation. Council assessment time is separate Ba02 – 25 days and Ba01 – 10 days. Outside our control; however, by submitting a complete and compliant approval pack from the outset, we reduce the risk of information requests that commonly delay patio approvals.

A patio is generally defined as an open-sided structure enclosed on no more than half of its perimeter, with a roof that is impervious to water and used for outdoor living or entertainment. While patios are considered Class 10a non-habitable structures, they are still subject to patio council approval and patio building approval requirements in Western Australia.

When is planning (development) approval required for a patio?
Planning approval (development approval) may be required before a building permit can be issued. If required, it must be obtained first.
Planning approval is generally NOT required if the proposed patio:
Is located on land zoned Residential, Mixed-Use, Business, Commercial, Rural Community, or Special Residential, and
Fully complies with the R-Codes (including setbacks, height, and site coverage)
Planning approval is ALWAYS required if:
The patio varies from the R-Codes, or
The property is zoned Rural Resource, General Rural, or Special Rural
Common triggers for patio planning approval
A patio planning approval is typically required when one or more of the following apply:
The patio is visible from the street and designed to integrate with the dwelling
The patio is located at the front of the property and does not meet minimum or average street setbacks under the R-Codes
The patio is closer than 1.5 m to a side or rear boundary and has a length greater than 9 m
The proposal raises natural ground levels by more than 0.5 m (e.g. decking or platforms)
The patio causes site coverage to exceed limits or covers more than one-third of the minimum outdoor living area required under the R-Codes
If any of the above applies, patio council approval is required before construction or approval can proceed.
Do I need a building permit for a patio?
A building permit (patio building approval) is required for:
Any patio greater than 10 m², or
Any patio that is attached to an existing building, regardless of size
Patios under 10 m² and under 2.4 m in height may be exempt only if:
There is no existing patio on the property, and
The patio is completely freestanding
If these conditions are not met, a patio permit in WA is still required.
What if my patio is already built?
If your patio was built without approval, you will need a retrospective patio approval (BA18).
